These Terms are written for Protein Sample Kit's current model: independent resale of third-party protein food products that are repackaged into samples in a commercial kitchen.

If you do not agree to these Terms, do not use the site or place an order. These Terms are effective as of June 8, 2026.

1. Who we are

Protein Sample Kit sells curated sample kits of third-party protein food products. You can contact us at proteinsamplekit@gmail.com. Our mailing address is 1278 First Avenue, New York, New York.

These Terms apply to this website, our checkout flow, and any order placed with us. By using the site or placing an order, you agree to these Terms.

2. Product source, repackaging, and FDA registration

We buy third-party protein food products and repackage them into sample portions. The samples are repackaged by Protein Sample Kit, not by the original brand owner, manufacturer, or licensor.

Repackaging is performed in a commercial kitchen that has an FDA food facility registration. FDA registration is not the same as FDA approval, sponsorship, inspection, certification, or endorsement of our products or business.

We maintain our own repackaging records, order records, lot or batch references when available, and complaint or recall records. We reserve the right to remove, quarantine, or stop selling any sample if we identify a quality, labeling, availability, or food-safety concern.

3. Third-party brands and no affiliation

We are an independent reseller and sample-kit business. We are not affiliated with, endorsed by, sponsored by, authorized by, or approved by any third-party brand referenced on this site.

Third-party names, product names, trademarks, logos, trade dress, and other identifiers belong to their respective owners. We use third-party brand and product names only to identify the original source products included in repackaged sample portions. Third-party brand owners are not responsible for our website, repackaging, labels, samples, shipping, customer service, complaints, or recall process.

4. Product images and product information

Product images on the site may be AI-generated, edited, illustrative, or inspired by the appearance of original products. Images are provided to help identify product choices and may not show the exact package, label, serving container, color, texture, or appearance you receive.

Product names, flavors, ingredients, nutrition information, allergen information, and serving details may come from manufacturer materials, original product labels, supplier information, or our own repackaging labels. Manufacturers can change their formulas, labels, allergens, warnings, or product names without notice. Always review the label and package information included with your sample before consuming it.

If a product becomes unavailable or raises a quality or labeling concern, we may cancel the affected item, contact you about a replacement, or refund the affected portion of the order.

5. Allergens, dietary needs, and safety

Protein powders and related food products commonly contain, are derived from, or are made around major food allergens, including milk, soy, wheat, eggs, tree nuts, peanuts, sesame, and other ingredients. Repackaged samples may also be handled in an environment where multiple allergens are present. Cross-contact is possible.

Do not consume a sample if you have an allergy, intolerance, medical condition, dietary restriction, or ingredient concern unless you have reviewed the label and are comfortable with the risk. If you experience trouble breathing, swelling, severe allergic symptoms, or any urgent medical concern, seek medical help immediately.

Our products are food samples. They are not medical advice, nutrition advice, or a substitute for a clinician, dietitian, or other qualified professional. We do not claim that any sample diagnoses, treats, cures, or prevents any disease.

6. Storage and use

Store samples in a cool, dry place unless the label says otherwise. Keep samples sealed until use, away from children and pets, and away from moisture, heat, pests, and contamination. Do not use a sample if the package appears damaged, opened, leaking, contaminated, or otherwise unsafe.

Samples are sold for personal tasting and comparison. They are not sold for resale, relabeling, redistribution, or use as ingredients in products you sell to others.

7. Orders, payment, taxes, and availability

Orders are accepted only when we or our payment provider confirm them. We may reject, cancel, or refund an order if a product is unavailable, if pricing or product information is incorrect, if fraud or abuse is suspected, if shipping is not available, or if we identify a food-safety, labeling, or legal concern.

Payment, billing, tax, shipping, and fraud-screening details are handled through Stripe and other service providers. You agree to provide accurate checkout and delivery information and to update us promptly if anything is wrong.

Prices, kit contents, shipping fees, taxes, and availability may change. We are not responsible for typographical, image, pricing, tax, availability, or product-description errors, but we will correct known errors when practical.

8. Shipping, delivery, returns, and refunds

Shipping options and delivery estimates are shown during checkout when available. Delivery estimates are estimates unless we expressly state otherwise. If an order is materially delayed, we may contact you with options required by applicable law.

Because samples are food products, opened, damaged, used, or returned samples generally cannot be accepted for resale. Contact us if your order is missing, damaged, delayed, incorrectly packed, or otherwise wrong. We may request photos, packaging details, order information, and lot or repackaging details before deciding whether to replace, refund, or otherwise resolve the issue.

9. Complaints, adverse reactions, and recalls

Report product complaints, packaging issues, labeling concerns, suspected contamination, adverse reactions, or recall questions by emailing proteinsamplekit@gmail.com with your order number, product or sample name, issue details, photos if relevant, and any lot, batch, or repack date available.

We may review complaint records, quarantine inventory, contact suppliers, send customer notices, issue refunds or replacements, or take other actions if we believe a complaint may involve safety, allergens, labeling, contamination, foreign material, spoilage, or a repeated issue.

10. California Proposition 65

WARNING: Consuming this product can expose you to chemicals including lead and cadmium, which are known to the State of California to cause cancer and birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov/food.

This warning is provided for California consumers and does not mean that a product is unsafe, that a violation has occurred, or that any government agency has evaluated or approved the product.

11. Privacy

Our Privacy Policy explains how we collect, use, disclose, and retain information. By using the site or placing an order, you acknowledge that your information will be handled as described in that policy.

12. Intellectual property and site use

The site design, text, photographs, graphics, selection flow, original packaging, and other materials we create are owned by us or our licensors. You may use the site only for personal shopping and ordinary interaction with our business.

  • Do not copy, scrape, resell, frame, or misuse the site or its content.
  • Do not interfere with checkout, security, inventory, pricing, or site operation.
  • Do not use the site to submit false, misleading, abusive, or unlawful information.

13. Disclaimers

To the maximum extent permitted by law, the site and products are provided "as is" and "as available." We disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where those warranties cannot be disclaimed under applicable law.

Nothing in these Terms limits any rights you may have under non-waivable consumer protection, food-safety, product-liability, or other applicable laws.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or reputational harm.

To the maximum extent permitted by law, our total liability for any claim relating to the site, products, or an order is limited to the amount you paid for the order giving rise to the claim. This limitation does not apply where prohibited by law, including for liability that cannot be limited for personal injury, gross negligence, intentional misconduct, or statutory rights that cannot be waived.

15. Disputes, arbitration, and class-action waiver

Please contact us first so we can try to resolve the issue informally. If we cannot resolve a dispute within 30 days after written notice, either party may proceed as described below.

To the maximum extent permitted by law, disputes arising from these Terms, the site, or an order will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an eligible claim in small claims court or seek emergency injunctive relief for intellectual-property or security misuse.

You and we waive the right to a jury trial and the right to participate in a class action, collective action, private attorney general action, or other representative proceeding to the maximum extent permitted by law. Arbitration will be individual only.

You may opt out of this arbitration section by emailing proteinsamplekit@gmail.com within 30 days after your first order and stating that you opt out of arbitration. If you opt out, the rest of these Terms still apply.

16. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict of laws rules. If a dispute is not subject to arbitration and is not brought in small claims court, it must be brought in a state or federal court located in New York County, New York, to the extent permitted by law.

17. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new last-updated date. Changes apply when posted unless the updated Terms say otherwise.
